Conversely, in an “at-fault” system, injured motorists can proceed with legal action against the person responsible for their accident (normally, by filing a third-party insurance claim). This can be done regardless of how severe or minor the collision was.

Texas is an “at-fault” state. That means that after an accident, you have the right to pursue compensation directly from the responsible party’s insurance company. You also have the option of filing a lawsuit against them if they refuse to fully compensate you for your injuries, property damage, and financial losses.
