How Safe are Amazon Trucks and 18-Wheelers?
Many people are surprised to learn that Amazon doesn’t employ most of the drivers who operate the 18-wheelers, trucks and delivery vans bearing its name. Among other things, the online retailer relies on thousands of small, independent carriers to move freight between its warehouses and distribution centers. Those companies are responsible for hiring their own drivers, maintaining their own vehicles, and ensuring compliance with federal trucking regulations. Meanwhile, Amazon sets the routes, the timelines, and the delivery windows.
According to a recent review of federal records conducted by CBS News, the rate of unsafe driving violations among the company’s contractors was roughly 89 percent higher than that of non-Amazon carriers in each of the 6 months covered by the analysis.
This makes sense when you consider that to win Amazon’s business, contracted carriers need to move freight quickly while keeping costs low. Like all trucking companies, they’re faced with a shortage of qualified truckers and are often forced to hire young, inexperienced drivers. The pressure to keep their vehicles on the road and meet Amazon’s tight delivery schedules increases the likelihood that they’ll skimp on training and push their drivers to work long hours, even when they’re too fatigued to safely operate their rig.
Amazon often exploits this system to argue that it bears no legal responsibility when a contracted driver causes a wreck, even when its own monitoring systems flag unsafe driving behavior.
Protect Your Legal Rights After an Amazon Truck Crash
The hours and days after a major crash like the Smith County Amazon 18-wheeler accident can be incredibly chaotic, and it’s normal for victims and their families to feel overwhelmed. But while a lawsuit might be the last thing on your mind, taking immediate steps to safeguard your legal rights could well determine whether you recover the maximum compensation for all your injuries and losses, or walk away with nothing at all.
- Call 911 and Get Medical Attention: Even if you feel okay, many serious injuries won’t show symptoms right away. Delaying treatment puts your health at risk and gives the trucking company’s insurance carrier a reason to question whether the crash caused your injuries.
- Document Everything You Can: If you’re physically able and it’s safe to do so, photograph the vehicles, the road, the point of impact, skid marks, and any debris at the crash scene. Get the truck driver’s name, contact information, and the truck’s USDOT number. If there were witnesses, take down their names and contact information.
- Don’t speak with Amazon, the Trucking Company, or Their Insurers: An adjuster will likely call within hours. They may sound helpful, but they’re not interested in your well-being. You’re not obligated to give a recorded statement, sign anything, or accept their first settlement offer, no matter how hard they push, and it’s in your best interest not to do so.
- Don’t Admit Fault: It’s best not to speculate about fault or causation when speaking with law enforcement, other drivers or witnesses, or the medical staff treating you in the ER, even if you think you bear some responsibility for the crash. Leave that determination to your legal team and the qualified experts and investigators they’ll call on when building your case.
- Preserve What Evidence Yo Can: Get a copy of the police report and save any dashcam footage, medical records, bills, and receipts. Write down everything you remember about the crash while it is still fresh, and keep a pain journal detailing the impact of your injuries on your ability to work, your daily life, and your relationships with family and friends.
- Keep Al Medical Records: Hold onto every bill, prescription, and record related to your injuries. These records will help your legal team establish the extent of your injuries and the financial toll they’ve taken on your life.
- Limit Discussion of the Accident and Your Injuries: Anything you say to anyone can be taken out of context. Even an innocent social media post could be used by Amazon’s legal team to question the nature and seriousness of your injuries and undermine your credibility.
- Contact an Experienced 18-Wheeler Accident Lawyer. Amazon and its insurers call on high-powered teams of attorneys to protect their interests. You need to hire an experienced truck accident attorney just as quickly to protect yours.
