Record-Setting Truck Accident Settlement in Fatal 18-Wheeler Crash

Our Texas 18-Wheeler Accident Lawyers recently reached a record-setting (and confidential) settlement for our client and her 4-year-old son after an 18-wheeler wreck in Jefferson County that left her husband dead.

As often happens after a serious crash, the trucking company, the driver, and their attorneys attempted to blame our client’s husband for the fatal crash, claiming he was distracted by his cell phone.

After taking several depositions and working closely with the Texas DPS officers who investigated the accident, our 18 Wheeler Accident Attorneys were able to prove that our client’s husband hadn’t used his phone at all that morning. Largest Verdict Ever Against R&L Trucking Company

Causes of Texas Truck and 18-Wheeler Accidents

18-wheelers and other large commercial trucks are permitted to weigh as much as 80,000 pounds without requiring special permits. Even at low speeds, a collision is likely to cause severe and potentially life-threatening injuries, particularly to the drivers and occupants of smaller passenger vehicles.

Some of the most common causes of negligent truck and 18-wheeler accidents include:

  • Fatigued Truck Drivers: although the federal Hours of Service Regulations establish strict rules for how long truckers and other interstate commercial drivers can remain on the road without taking a break, far too many trucking companies set unrealistic schedules that force their drivers to push and even exceed those limits. Unfortunately, many truckers will use cellphones, computers mounted in their cabs, and even eat meals on the road to stay on schedule and deliver their loads on time.
  • Speeding: compared to passenger vehicles, it takes significantly more time for a heavy truck or 18-wheeler to stop in an emergency, especially when traveling at high speeds. In fact, excessive speed contributed to about 45% of fatal truck and 18-wheeler accidents in the United States in 2018.
  • Impatient, Reckless, or Aggressive Truckers: tailgating, erratic lane changes, unsafe passing maneuvers, and other poor driving decisions contribute to a significant percentage of commercial trucking crashes.
  • Improperly Loaded Cargo: when cargo isn’t loaded correctly and shifts during transport, a semi-truck can go off balance and cause the driver to lose control, resulting in a crash.
