Resolving a Case Pre-suit

If you have been injured in any type of accident caused by another party’s negligence, here are the steps that you can take to improve your chances of resolving your case out of court:

  • Seek the best medical treatment, even if you have no symptoms. This is the most important step in any injury case. And remember, do not sign a settlement agreement with your insurance company without first talking to an attorney. Once you sign this agreement, your insurance company has no further obligation to you – even if you are facing additional medical bills. Our trial lawyers can help you seek and obtain full compensation for your injuries and expenses. Our goal is to help you achieve maximum medical improvement – no matter what the cost
  • Contact a personal injury lawyer who has experience negotiating with and going to trial against insurance companies. While you focus on recovering and getting the necessary medical treatment, we begin investigating and acquiring the evidence needed to prove your case.
  • Make a demand with the insurance company. Our firm will help you seek compensation to cover every past, current, expected, and long-term cost of your accident: medical expenses, pain and suffering, past and future wages, past and future disfigurement (such as broken bones, scarring, or amputation), and all other damages available to you. Depending on the facts of the case, we may also be able to recover punitive damages, which is compensation in excess of actual damages intended to punish the defendant for their wrongful conduct. We usually give the insurance company 10 days to respond to our demand. If they don’t or come back with an inadequate offer, we immediately file a lawsuit and move forward with proving the case.

Resolving a Case After the Lawsuit is Filed

After we’ve filed your lawsuit, we move to the discovery stage, where our lawyers and experts investigate the facts of the accident. We generally work with a team of outside experts such as accident reconstructionists and doctors to ensure that we have gathered and evaluated all the evidence needed to build your case.

Once we have completed discovery, we set a trial date with the court. Before and after we set this date, we will attempt to resolve your case through mediation or settlement. If the negotiations fail, we proceed to trial.

Zehl & Associates, LLP, has an impressive record of success in and out of the courtroom: since 2007 alone, our lawyers have recovered hundreds of millions of dollars for our clients through settlements and trials.
